Chief Justice Ian Chang on Thursday cleared Chartered Accountant and Attorney-at-Law Christopher Ram of breach of contract, misrepresentation or improper conduct during his receiver-managership of Hotel Tower Ltd ending more than a decade of legal wrangling.

The action was brought in 2000 by Cara Lodge against Ram and the Bank of Nova Scotia which appointed him as receiver-manager, from 1999 to 2003, to secure its exposure to the Hotel Tower Limited of more than US$2.5M .

Shortly after the closing of bids invited by Ram, Cara Lodge, one of the bidders, through its directors Paul Stephenson and Shawn McGrath brought an action against Ram effectively bringing the sale of the Hotel to a halt.

Demerara Waves understands that the CJ in his 15-page judgment ruled that the action against Ram for damages for breach of contract was “wholly misconceived” and that the evidence did not reveal that he had made any representation to anyone which could give rise to a claim for damages for misrepresentation whether in contract or tort.

The court dismissed the action on the ground that the evidence does not support the material allegations of fact, and on a point of law the Chief Justice held that the facts did not support the existence of a collateral contract. 

Ram was represented by Edward Luckoo S.C. whilst the Bank of Nova Scotia was represented by Rex Mc Kay S.C. with Richard Fields S.C. and Bettina Glasford.

Cara’s action was initially brought by Ashton Chase, S.C. who was succeeded by Sanjeev Datadin and Dr. Fenton Ramsahoye, S.C.
