Attorney General, Anil Nandlall on Thursday rejected claims of conflict of interest between Auditor Director in the Auditor General’s Office, Geetangali Singh and her husband, Finance Minister, Dr. Ashni Singh, saying that she had been acting in that position for several years and there has been no evidence of her work having been compromised.

“Since no scintilla of evidence has, thus far, been produced which establishes or would tend to establish that there is a single verifiable instance of an actuality of conflict of interest, one is forced to presume that the allegation of conflict of interest is predicated merely upon the fact of this marital relations and nothing else. In short, it is conflict of interest based upon perception and not actuality,” said Nandlall in a statement titled “Auditor General’s independence under siege: the case of Geetangali Singh.”

But Chairman of the Public Accounts Committee, Carl Greenidge said Mrs. Singh acting in that position for the past seven years, including a number while her husband has been Finance Minister, does not make her holding that office professionally ethical. “The fact that the person has been acting and sanctioned by the very government is no justification or no proof that it is not illegal,” Greenidge told Demerara Waves Online News (www.demwaves.com).

Alluding to the fact that only recently government removed the Auditor General’s Office from being a budget agency to one that draws its financing directly from the Consolidated Fund in accordance with Guyana’s constitution, he noted that Mrs. Singh’s appointment is unacceptable on similar grounds. “The fact that something is happening doesn’t prove that it’s legal,” he added.

Asked whether there has been evidence of her acting improperly, Greenidge said the elimination of conflict of interest was aimed at avoiding the participants from committing a crime or error. Greenidge declined to be drawn into precise comment on why previous PAC Chairmen Winston Murray and Volda Lawrence had not raised any objections.

Labeling the criticisms by the opposition as “politically inspired and concocted,” the Attorney General noted that the Auditor General’s Office is constitutionally insulated from interference by any person or entity. Transparency Institute of Guyana Inc; the local affiliate of Transparency International, has also pointed to conflict of interest between the Singhs since she could pronounce on reports of state entities in which the Finance Minister may have a role to play.

That comment comes against the background of complaints being lodged against the Finance Minister, himself an accountant, to the Institute of Chartered Accountants of Guyana and a Caribbean monitoring body for the professionals.

The Attorney General accused critics of hastily coming to a conclusion without becoming familiar with the relevant facts and circumstances aimed at conducting a mature analysis. “Instead, conclusions have been arrived at, inferences drawn and judgment rendered in a most heedless, capricious and arbitrary fashion.

Mrs. Singh began working at the Auditor General’s office on 1992 as an Audit Clerk and, according to Nandlall “she ranks among the most qualified. 

 

Arguing that Mrs. Singh’s performance is testimony to her credibility since a number of financial irregularities have been unearthed and several audit queries made. “The very opposition has made tremendous use of these irregularities and queries in their political pursuits. They continue to do so until now. As they did so, not once did we hear an objection to Mrs. Singh’s functioning in that office or her connection to the Minister of Finance. This alone denudes their current posture of any bona fides and credibility.”

Nandlall contended that since no one had objected to Mrs. Singh acting as Audit Director for the last seven years, one  can forcefully argue that their protracted prior failure to object amounts to an acquiescence and creates in favour of the Auditor General and Mrs. Singh, the benefit of a legitimate expectation that they will continue their no-objection. 

“The hypocrisy is nakedly revealed by the fact that the very Auditor General, audits the accounts of the same Parliament to which he is answerable. Yet, not a single utterance is made of this apparent conflict.  The squabble is much ado about nothing,” the Auditor General added.

Hello Anil this is what I would call a "duuhhhh" moment, How can they not be a conflict of interest between 2 positions that allows the other party to have intimate knowledge of each other work, with one of them being responsible for a potential investigation of any wrong doing on the part of the other and at the same time being intimate partners , how do you not count this as not being a conflict of interest blows my mind.In fact that is the recipe for the perfect crime cover up.

It seems that for this corrupt administration they are like the Proverbial Ostrich with their heads so far down in the sand they have become incapable of any perception of wrong doing, for them being corrupt is like a walk in the park.

I would like the joint opposition to use its Parliamentary Majority to have this Position revoked for it stinks to the high Heaven,this is tantamount to the Devil trying himself in hell with his fallen angels making up the Jury panel.

This f**king guy Nandalall is a judicial dunce.

He is only Guyana's AG because of nepotism and his personal push to have that position.
He will go down as the most uneducated, least qualified and judicially ignorant Attorney General in the whole Caribbean.
Jus check the resume of all the others before him and even now, to see my point.

Let the combine opposition focus on a no confidence vote, call an election and let this dumb fella along with the other PPP jailbirds come out of office.

He would also be labelled as the shortest sitting AG.

So why didn't the constitutionall y independent Audit Office see to it that NICIL, which is chaired by the Finance Minister and whose board members are cabinet ministers, file annual accounts and lay them before Parliament as required by law?

The law was broken by the Finance Minister. His wife worked at the Audit Office and knew about the law-breaking. The Audit Office was complicit in the law-breaking.

The excuse that Mrs, Singh worked for seven years at the Audit Office and no one complained does not wash: November 28 ushered in a new dispensation of accountability and responsibility. Anil Nandlall and his cohorts refuse to get used to the new era and are living in the pre-November 28 era.

It was wrong then and it is wrong now. Better late than never. The fact that no one said anything about it years ago does not make it right and is a flimsy excuse of the AG of Guyana to use. God come up with a better argument that than. It was wrong then and it is wrong now.

For example, if someone was a serial killer and some people knew about it, but did not say any thing and the killer went on killing people all the time, according to the AG it will be wrong to intervene and bring the killings to an end now because if you knew about it before and did nothing you should not do anything about it now. let the killings continue. My take on his argument.

It is true that Nandlall is a judicial dunce. He should check the basic definition of conflict of interest and he will find that the main ingriedient is APPEARANCE.If it appears to the ordinary reasonable man that the one party is likely to be influenced by his/her relationship to the other in the performance of his duty then there is the appearance of one being able to be influenced private considerations/factors. Here the actor (man responsible for gov't accounts) is the husband of the watchdog of gov't accounts(Audito r General's office)If this does not give the APPEARANCE of conflict then what does. Apart from this I hope that the AG will refer to all the authoritative writings on the matter from Australia and Canada, as well as the relevant cases and advise himself Next time I will quote them for him.
Her qualifications and whether she had performed her duties with integrity before while laudible and perhaps beyond question are irrevelant to the issue. To found his defence on those grounds as a Lawyer is disgraceful to the profession and should attract the attention of the Law Association.

As a board member of Guysuco togther with ur fellows u implemented a system where two senior managers in Guysuco who are husband and wife cannot serve on the same estate. K SingH and Maurine S husband and wife (both were senior maanagers at the estate level)were working at Albion and Skeldon. Now u r silent on a more complicated and illicit professional realtionship that is a conflict of interest. Mr President u need to speak up>

I read with great amusement these comments which clearly emanate from the unschooled in matters of law... and eveidently everything else. All i wish to add to this less than intelligent attack on the AG s well written article is that those who criticise should at least acquaint themselves with the facts before positing a view. Seems they are too blinded by prejudice or stupidity to intelligently posit an opinion.. I find the current AG to be both intelligent and honourable in every respect and I am proud of the tremendous job he is doing> none of the persons whose comments are posted here seem fit to kiss his footbottom.
