The government has protested Thursday’s decision to disallow business in the name of Home Affairs Minister Clement Rohee to proceed in the National Assembly with Attorney General Anil Nandlall saying it has plunged the House into “greater travesty.” The minister was listed on the Order to present two new bills for first reading and to lead the debate on the second reading of the Firearms (Amendment) Bill but Deputy Speaker Deborah Backer indicated that she had conveyed to the government side prior to the sitting that she would disallow the readings in keeping with “the ruling of the House.” Prime Minister Samuel Hinds subsequently rose and stated that the government disagreed with her decision since the bills were slated to be dealt with at the sitting. In response Backer said she was merely carrying out what she understood to be “the decision of the majority of the House.” The House, without government support, passed a motion of no confidence in Rohee last July which called on the president to remove him from the post but it was non-binding and the APNU subsequently tabled a motion to block him from speaking in the Assembly as home minister. However, before it could be debated Speaker Raphael Trotman referred the matter to the Committee of Privileges to determine whether the House could bar the minister from speaking and additionally ruled that no business in the name of the minister would be entertained pending the body’s decision.

Nandlall on Friday observed that Backer had based her ruling on a faulty premise since no motion to bar the minister from speaking in the House had been passed. “The Deputy Speaker has thrown the National Assembly into greater travesty by purporting to act upon a decision of the majority of the National Assembly which the National Assembly in fact never made,” Nandlall told Demerara Waves Online News. The government had taken the matter to court and Trotman decided to await its ruling before proceeding. Chief Justice Ian Chang has given a preliminary ruling stating that the House could not take away an elected member’s right to speak but noted that the court could not enforce that decision. Trotman last week allowed Rohee to address the House under the heading “Statements from Ministers,” citing the existing crime situation as his reason. He later stated that any further accommodation of the minister would be done on a case-by-case basis until the matter was resolved. Nandlall on Friday interpreted the Speaker’s decision to allow Rohee to speak as the partial gag being lifted and opined that there was “absolutely no basis” for Backer to have prohibited the minister from speaking. Efforts to reach Trotman have so far been unsuccessful. |

The House Speaker is always appointed by a parliamentary majority vote, making the Speaker answerable to House.
The House voted to gag Rohee. The AG took the matter to court. The court said Rohee has a right to speak in Parliament, but the court can't enforce that; leaving it up to the Speaker.
The Speaker must abide by the majority vote or be replaced. Sorry, this is straight-up political reality! Our steel is sharper and harder than their steal!

You are a school drop out...can you spell the word constitution or know what it is......not even Backer knows it.

I sorry, but I do have to inform you that the house never voted on any motion to gagged MP Mr Rohee. The motion was presented and it was in the debating stage when the speaker disallowed a vote on the matter instead choosing to refer it to the COP. I am certain the records of the house will show this. The Court have ruled that gagging The MP is unconstitutiona l, however the court cannot order the speaker. The speaker have corrected this unconstitutiona l act by allowing the the Minister to speak stating his decision is final. So Miss Backer is not only flouting the constitution and the Court but also the speaker ruling. Miss Backer need to present the motion she refer to, stating when the house vote to pass such motion. She also need to justified why acted to against the constitution knowing that or is expected to know that her act is unconstitutiona l since the high court of the land with the authority to interpreted the constitution have previously rule such act to be unconstitutiona l. Should the house not treat this as urgent business and acted appropriately to bring resolution to this issue the President is duty bound to act. The President is responsible for the security of this nation and cannot have a parliament in place that is openly breaking the constitution of the land which is the highest law of the land and to which all others should be inline with. There is no excuse as to the lack of knowledge on this matter Miss Backer is a lawyer,and the High court have ruled that it is unconstitutiona l,and that ruling stands until it have been change by a higher court. I am looking at you Mr President no politics playing here. Let the people speak time for election regardless who win its time for election.
